Voxel Prep Terms and Conditions
1. About these Terms
1.1 These Terms and Conditions (the "Terms") are a legal agreement between you and Voxel Prep, based in Ontario, Canada ("Voxel Prep", "we", "us"). They apply to your use of our website and application (the "Service"). Our full contact details, including our business address, are on our Contact page.
1.2 By creating an account, clicking "I agree", buying a pass, or using the Service, you agree to these Terms, our Privacy Policy and our Copyright and Intellectual Property Notice, which form part of this agreement. If you do not agree, do not use the Service.
1.3 You agree that this agreement is formed electronically and is as valid as a signed paper contract, consistent with applicable electronic signature and electronic commerce laws.
2. Eligibility and your account
2.1 You must be at least 18 years old to use the Service. If you live in Quebec, we present the French version of these Terms to you first, and these English Terms apply to you only if you expressly ask to enter into the agreement in English (see section 21.5).
2.2 You must give accurate information and keep it up to date. You are responsible for all activity on your account and for keeping your password secure. Tell us promptly at prepvoxel@gmail.com if you think your account has been accessed without permission.
2.3 An account is for one person. You may not share it, sell it, or let anyone else use your pass.
3. What Voxel Prep provides
3.1 Voxel Prep is a practice tool for medical school interview preparation. Depending on your plan, it lets you answer practice questions by audio or video, produces a transcript, and generates scored feedback against a rubric, along with a model rewrite of your own answer and a record of your progress.
3.2 At launch, the Service covers behavioural and ethical-scenario questions only. We may add, change or remove features, questions, rubrics and free offerings (including the Question of the Day) over time, subject to section 6.6 for paid passes.
4. No affiliation and no guarantee
4.1 Voxel Prep is an independent service. It is not affiliated with, endorsed by, or sponsored by OMSAS, OUAC, CaRMS, the AAMC, Acuity Insights, or any medical school, university or admissions body.
4.2 Practice questions are written by us in the style of common interview formats. They are not real interview questions from any school, and we make no claim about what any school will ask or how it will score applicants.
4.3 Scores and feedback are educational aids. They do not predict, and we do not guarantee, an interview offer, an admission decision, or any other outcome. We do not provide admissions, legal, medical or career advice.
5. AI-generated feedback
5.1 Transcripts and feedback are produced with automated systems, including artificial intelligence provided by third-party service providers. They can contain errors, mishear words, or miss context. You may edit your transcript before scoring, and you should use your own judgment about any feedback.
5.2 A score reflects how a particular answer performed against our rubric on one occasion. It is not an assessment by an admissions committee or a licensed professional.
6. Plans, prices and payment
6.1 Free access**. We may offer free features, such as a daily practice question (the "Question of the Day"), with no payment card required. What free access includes, how often it is available, and any limits are described in the Service and may change at any time (see 6.6).
6.2 Paid passes. You can buy a paid pass, such as a 3-month pass, at the price shown on our pricing page and again at checkout before you pay. Each pass is a single payment, gives access for the stated period from the date of purchase, and does not renew automatically.
6.3 Prices are shown in the currency and amount stated on our pricing page and again at checkout, before any applicable taxes. If tax applies to your purchase, it will be itemized, and the total you will pay is shown before you confirm.
6.4 Payments are handled by our third-party payment processor. We do not store your full card number. If a payment fails or is reversed, we may suspend paid access until it is resolved.
6.5 We may apply reasonable fair-use limits to any plan, including free access, to prevent automated or abusive use. Current limits are described in the Service or the Plan Details, and we will tell you before you reach one.
6.6 Plan Details and changes. Each plan's features, limits, duration and price (the "Plan Details") are shown on our pricing page, in the Service and at checkout, and form part of your purchase. We may change free access, introduce new plans, or change the Plan Details and prices for future purchases at any time by updating the Service or the pricing page, without changing these Terms. A change never reduces what a pass you have already bought includes, or increases its price, during the period you paid for (see section 20.2).
7. Cancellations, refunds and your consumer rights
7.1 14-day money-back guarantee. If you ask for a refund within 14 days of buying a paid pass and you have attempted fewer than 10 graded questions since buying it, we will refund the full price you paid. A graded question is a practice question whose answer you submitted for scoring. For a pass bought later, the number of questions stated in the Plan Details when you buy applies. After 14 days, or once you have attempted 10 or more graded questions, we review each refund request case by case and may grant or refuse it at our discretion. We reply in writing to every request sent to prepvoxel@gmail.com. This section does not limit your rights under section 7.3.
7.2 If a pass is not delivered, or the Service stops being available for a period because of our fault, we will extend your pass or refund the unused portion at your choice.
7.3 If you are an Ontario consumer, you also have the rights given by the Consumer Protection Act, 2002 (Ontario). For example, if we did not give you the required information about your purchase or a clear chance to accept or decline it, you may cancel within 7 days of receiving a copy of this agreement; if we did not send you a copy within 15 days, you may cancel within 30 days of the purchase date. Nothing in these Terms limits those rights. If you live in Quebec, you also have the rights given by the Consumer Protection Act (Quebec), which the French version of these Terms describes, and nothing in these Terms limits them.
7.4 Approved refunds are returned to your original payment method within 10 business days.
8. Your licence to use Voxel Prep
8.1 Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own interview practice.
8.2 All rights not expressly granted are reserved by Voxel Prep.
9. What you may not do
9.1 You may not, and may not help others to:
- copy, scrape, crawl, bulk-download or systematically extract questions, rubrics, feedback, model answers or other Voxel Prep Materials, manually or by automated means;
- reverse engineer, decompile or try to discover our source code, AI prompts or scoring logic, except to the extent the law expressly permits despite this restriction;
- use Voxel Prep Materials or Service outputs to train, fine-tune or evaluate a machine-learning model, or to build or improve a competing product or service;
- bypass access controls, rate limits or security measures, or use bots or other automated tools to access the Service;
- resell, sublicense, publish or share questions, feedback or model answers outside your own personal use;
- upload anything unlawful, defamatory, hateful or infringing, or that you have no right to upload;
- include in your recordings any real patient information, or identifying details about other people, that you do not have the right to share; or
- interfere with or disrupt the Service or other users.
10. Your recordings, transcripts and content
10.1 You own your recordings, transcripts and edits ("Your Content"). We do not own them.
10.2 You give us a non-exclusive, worldwide, royalty-free licence, limited to the time Your Content is stored with us, to host, store, copy, transcribe, analyze and display Your Content, and to have our service providers do so, only as needed to operate the Service for you: to generate your transcript, score and feedback, show your history, keep the Service secure, and comply with law.
10.3 We will not use Your Content to train or improve artificial-intelligence models unless you give us separate, explicit opt-in consent, which you can withdraw at any time.
10.4 You can delete any attempt, or your whole account, at any time. Deleting an attempt removes its recording, transcript and score together. How long backups and logs are kept is explained in our Privacy Policy.
10.5 You promise that you have the right to submit Your Content and that doing so does not break any law or anyone's rights.
11. Privacy
11.1 Our Privacy Policy explains what personal information we collect, why, who processes it on our behalf (including AI and cloud providers, some of which may store or process data outside Canada), and your rights under Canadian privacy law. Before your first recording, we will ask for your separate consent to record and process it.
12. Voxel Prep's intellectual property
12.1 The Service, its software, question bank, rubrics, feedback templates, model answers, AI prompts, design, text, graphics, logos and trademarks (the "Voxel Prep Materials") are owned by or licensed to Voxel Prep and protected by copyright, trademark and other intellectual property laws and international treaties. See our Copyright and Intellectual Property Notice.
12.2 If you send us suggestions or feedback about the Service, you agree we may use them without payment or obligation to you.
13. Third-party services
13.1 The Service relies on third-party providers (for example hosting, storage, payments, transcription and AI). We are responsible to you for the Service as a whole, but we are not responsible for third-party websites or services that you choose to open through links on the Service.
14. Availability and changes to the Service
14.1 We aim to keep the Service available but do not promise it will be uninterrupted or error-free. We may perform maintenance, and may change or discontinue features.
14.2 If we discontinue a feature or the whole Service during a period you have paid for, we will refund the unused part of your paid pass.
15. Suspension and termination
15.1 You may stop using the Service and delete your account at any time.
15.2 We may suspend or close your account if you materially breach these Terms, if required by law, or to protect the Service or other users. Where reasonable, we will tell you why and give you a chance to fix the problem first. If we close your account for a reason other than your breach, we will refund the unused part of any paid pass.
15.3 Sections that by their nature should continue after the agreement ends (including sections 9, 10.2 to 10.5, 12, 16 to 19) will continue.
16. Disclaimers
16.1 To the fullest extent the law allows, the Service is provided "as is" and "as available", and we do not give any warranty that the Service, scores or feedback will be accurate, complete, or suited to your particular goals.
16.2 Nothing in these Terms excludes or limits any condition, warranty or right that cannot be excluded or limited under applicable law, including the Consumer Protection Act, 2002 (Ontario) and, where it applies to you, Quebec's Consumer Protection Act.
17. Limitation of liability
17.1 To the fullest extent the law allows and subject to sections 17.3 and 17.4, Voxel Prep and its directors, officers, employees and service providers are not liable for indirect, incidental, special, consequential or punitive losses, or for lost opportunities (including a missed interview or admission), lost profits or lost data, arising from your use of the Service.
17.2 To the fullest extent the law allows and subject to sections 17.3 and 17.4, our total liability to you for any claim arising from the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the claim and $100 in the currency you paid in.
17.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or intentional misconduct, or for anything else that cannot be limited under applicable law.
17.4 If you are a consumer in Quebec, nothing in these Terms releases us from the consequences of our own act or the act of our representatives, or limits the rights that the Consumer Protection Act (Quebec) and the Civil Code of Québec give you.
18. Your responsibility
18.1 To the extent the law allows, you are responsible for losses and third-party claims that result from your breach of section 9 or from Your Content being unlawful or infringing.
19. Governing law and disputes
19.1 These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. If you are a consumer in Quebec, you keep the protection that the mandatory rules of Quebec law give you.
19.2 If you have a concern, please email prepvoxel@gmail.com first; we will try to resolve it within 30 days. This does not prevent you from taking other steps.
19.3 Disputes will be decided by the courts of Ontario, subject to section 19.4. Nothing in these Terms requires you to arbitrate a dispute or stops you from bringing a claim in the Ontario Superior Court of Justice or taking part in a class proceeding where the law gives you that right.
19.4 If you live in Quebec, you may bring a claim against us in the courts of Quebec, including those of the judicial district where you live.
20. Changes to these Terms
20.1 We may update these Terms. For material changes we will email you and post a notice in the Service at least 30 days before they take effect, and show the date and version at the top of this page. Changes to free access, to Plan Details, or to prices for future purchases are made as described in section 6.6 and do not require a change to these Terms.
20.2 If you do not accept a change that is unfavourable to you, you may refuse it and cancel, without cost, penalty or cancellation fee, by telling us no later than 30 days after it takes effect, and receive a refund of the unused part of any paid pass. Continuing to use the Service after the effective date, without having refused the change, means you accept the updated Terms. Changes will not increase the price of a pass you have already bought or reduce what it includes.
21. General
21.1 These Terms, the Privacy Policy and the Copyright and Intellectual Property Notice are the whole agreement between you and Voxel Prep about the Service.
21.2 If a part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right immediately, we have not given it up.
21.3 You may not transfer your rights under these Terms. We may transfer ours as part of a sale or reorganization of our business, and we will tell you if that happens.
21.4 Neither of us is responsible for delays caused by events beyond reasonable control, such as outages of internet or cloud providers, or natural disasters.
21.5 Language. These Terms are available in English and in French. If you live in Quebec, the French version is presented to you first, and the English version applies to you only if you expressly ask to enter into the agreement in English. The version you accepted is the one that applies, and the other remains available at no charge.
